About these terms
These terms apply to your use of the LolliLabz website and purchases from LolliLabz. By placing an order, you confirm that you have read and accepted these terms. If you are under 18, a parent or guardian should place the order for you.
LolliLabz is a small family business based in Melbourne, Victoria, Australia. You can contact us at hello@lollilabz.com.au.
Products and handmade variation
We aim to describe and photograph products accurately. Because items are 3D printed, assembled and finished in small batches, minor layer lines, colour variation, texture and small differences may occur. Screen settings can also affect how colours appear. These normal characteristics are not necessarily defects.
Product measurements are approximate unless stated otherwise. Decorations and props shown in photographs are not included unless the product description says they are.
Orders and acceptance
Submitting an order is an offer to purchase. An order is accepted when we confirm it and payment is authorised. We may contact you to clarify personalisation, availability, delivery or suspected errors. We may decline or cancel an order where a product is unavailable, information is incomplete, a price is clearly incorrect, fraud is suspected or we cannot safely or lawfully fulfil it. If we cancel after payment, we will provide an appropriate refund.
Prices and payment
Prices are shown in Australian dollars. LolliLabz is not currently registered for GST, so GST is not charged or stated as included. Delivery charges and any available discounts are shown before checkout is completed. Payment is processed through the payment methods offered at checkout. LolliLabz does not directly store complete payment card details.
Personalisation and customer content
You are responsible for checking names, spelling, dates, quantities, colours, uploaded photographs and other choices before ordering. We may reproduce customer-supplied content only to create, administer and support the order.
You confirm that you have permission to provide any photograph, name, artwork or other content you submit, and that our use of it to fulfil your order will not infringe another person's rights or break the law. We may refuse a custom request or customer-supplied content that is unlawful, infringing, unsafe, harmful, discriminatory, abusive or otherwise unsuitable.
Cancellations and changes
Contact us promptly if you need to change or cancel an order. We will try to help, but changes or cancellation may not be possible once production has started, materials have been committed or a personalised item has been made. Your rights under the Australian Consumer Law remain unaffected.
Production times
Most products are made to order. Production estimates are shown on relevant product or information pages and are separate from delivery estimates. Complex personalised, bulk, party or special orders may require a timeframe confirmed directly with you.
Product use and safety
Follow any product instructions and age or safety warnings supplied with an item. Unless clearly described as a toy, our decorative products are not toys. Products containing small parts are not suitable for children under three years and should be used with appropriate adult supervision. Keep PLA products away from high heat, open flame and prolonged direct sunlight.
Website, designs and intellectual property
The LolliLabz name, website design, original text, photography, graphics and other original website content belong to LolliLabz or are used with permission. Some products use designs supplied under commercial licences from independent designers. Those designers retain their applicable intellectual property rights. You may browse and purchase for personal use, but must not reproduce, sell or commercially exploit website content or product designs without permission.
We try to keep the website available and accurate but cannot promise uninterrupted or error-free access. Links to third-party websites are provided for convenience. Their content and practices are controlled by those third parties.
Liability and governing law
Nothing in these terms excludes, restricts or modifies rights that cannot lawfully be excluded, including rights under the Australian Consumer Law. To the extent permitted by law, LolliLabz is not responsible for indirect or consequential loss that was not reasonably foreseeable.
These terms are governed by the laws of Victoria, Australia. If part of these terms is unenforceable, the remaining terms continue to apply.
